Sus hallazgos destacan las consecuencias negativas de la sobrecriminalizaci\u00f3n, que ha convertido tantas infracciones civiles menores en delitos penales que el sistema de justicia penal est\u00e1 siendo llevado al l\u00edmite. A medida que acumulamos m\u00e1s y m\u00e1s tareas en el gobierno, este es cada vez m\u00e1s incapaz de cumplir con sus prioridades b\u00e1sicas. Para empeorar las cosas, los hispanos de EE. UU. est\u00e1n sufriendo las consecuencias de esta creciente desigualdad en el sistema de justicia y se enfrentan a graves barreras para la oportunidad que pueden durar toda la vida.   <\/p>\n<p>La carga de la sobrecriminalizaci\u00f3n ha llevado a nuestro sistema de justicia penal m\u00e1s all\u00e1 de sus l\u00edmites. En los \u00faltimos a\u00f1os, muchas infracciones han pasado de ser sanciones civiles a sanciones penales, lo que ha provocado que las cargas de trabajo ahora <a href=\"http:\/\/www.northwestern.edu\/newscenter\/stories\/2015\/06\/opinion-guardian-van-brunt-public-defenders.html\">superen el m\u00e1ximo recomendado<\/a> en los tribunales y departamentos de polic\u00eda de todo el pa\u00eds. Una de las consecuencias negativas de trasladar muchas responsabilidades costosas a los gobiernos es que les resulta m\u00e1s dif\u00edcil cumplir con sus otras obligaciones fundamentales seg\u00fan la ley, como la responsabilidad de proporcionar defensores p\u00fablicos o <a href=\"https:\/\/www.brennancenter.org\/press-release\/people-forced-appear-court-without-interpreters-violating-federal-law\">traductores judiciales<\/a>. En Estados Unidos, m\u00e1s de <a href=\"http:\/\/www.bjs.gov\/index.cfm?ty=qa&amp;iid=401\">56.000 personas<\/a> son acusadas de delitos graves cada a\u00f1o. De ellos, el <a href=\"http:\/\/www.northwestern.edu\/newscenter\/stories\/2015\/06\/opinion-guardian-van-brunt-public-defenders.html\">80 por ciento<\/a> son tan pobres que deben recurrir a abogados de oficio que, en algunos estados, pueden trabajar menos de <a href=\"http:\/\/www.northwestern.edu\/newscenter\/stories\/2015\/06\/opinion-guardian-van-brunt-public-defenders.html\">una hora por caso<\/a>.    <\/p>\n<p>La renta media hispana en Estados Unidos es inferior a la media nacional, lo que hace que esta comunidad tenga m\u00e1s probabilidades de necesitar la ayuda de defensores p\u00fablicos. Para empeorar las cosas, la falta de int\u00e9rpretes proporcionados por los tribunales tiene un impacto desproporcionado en los hispanohablantes con bajo dominio del ingl\u00e9s, y podr\u00eda abrir la puerta a malentendidos y errores judiciales. Si el tribunal no puede permitirse uno u otro, muchos hispanos pueden quedarse sin suerte.  <\/p>\n<p>Las consecuencias colaterales de tener antecedentes penales crean importantes barreras para la oportunidad. Estas consecuencias a menudo persisten mucho despu\u00e9s de que las personas hayan cumplido su condena, pagado sus multas o saldado su deuda con la sociedad. <\/p>\n<p>Seg\u00fan Carlos Mart\u00ednez, director de la Oficina del Defensor P\u00fablico del Condado de Miami-Dade, los acusados indigentes a menudo van a juicio sin abogado y sufren consecuencias legales que pueden durar toda la vida. \u201cLa gente est\u00e1 siendo condenada sin abogado y arruinando sus vidas porque no pueden conseguir trabajo\u201d, <a href=\"http:\/\/www.pewtrusts.org\/en\/research-and-analysis\/blogs\/stateline\/2016\/04\/11\/right-to-an-attorney-not-always-in-some-states\">dijo Mart\u00ednez<\/a>. <\/p>\n<p>La sobrecriminalizaci\u00f3n no es un asunto menor. Para abordar el problema de ra\u00edz, los legisladores deben emprender una seria reducci\u00f3n del c\u00f3digo penal.
